Permanent residence


A permanent residence permit entitles a foreigner to stay in Poland for an indefinite period of time (i.e. permanent).





A permanent residence permit may be issued to a foreigner who:

  • is a child of a foreigner who has a permanent residence permit in Poland, or a long-term resident's EU residence permit and is under his or her care and who:
    • was born after his parent has received a permanent residence permit in Poland or a long-term resident's EU residence permit, or
    • was born during the period of validity of the temporary residence permit held by his parent,
  • is a child of a Polish citizen and remains under his or her parental care,
  • is a person of Polish origin and intends to settle permanently in Poland,
  • is  remaining in a marriage, recognised by Polish law, concluded with a Polish citizen for at least 3 years prior to filing an application for a permanent residence permit and immediately prior to the submission of this application has lived in Poland continuously for at least 2 years on the basis of a temporary residence permit issued on the basis of a marriage to a citizen of Poland or on the basis of obtaining refugee status, protection or a humanitarian residence permit,
  • is a victim of trafficking in human beings and:
    • lived in Poland immediately prior to the submission of the application for a period of not less than one year more than 1 year on the basis of a temporary residence permit issued foreigners who are victims of trafficking in human beings,
    • cooperated with law enforcement authorities in criminal proceedings;
    • has a well-founded fear of returning to his country of origin, as confirmed by the prosecutor in charge of the case,
    • straight before submitting an application for a permanent residence permit resided continuously on the territory of the Republic of Poland by a period of not less than one year:
  • 5 years with regard to its award refugee status, subsidiary protection or on the basis of Humanitarian residence permits,
    • 10 years on the basis of a permit for tolerated stay granted on the basis of Art. 351 point 1 or 3,
    • 4 years on the basis of a temporary residence and work permit granted from for the purpose referred to in Article 114(1a) and has a source a stable and regular income sufficient to cover costs to support himself and his dependent family members;
  • he was granted asylum in Poland
  • has a valid Card of the Pole and intends to settle in Poland permanently.
